DANO MORAL DECORRENTE DO ABANDONO AFETIVO DO IDOSO: UMA ANÁLISE A PARTIR DA CONSTITUIÇÃO

Resumo

Este artigo procura salientar a possibilidade do cabimento de responsabilidade civil (cabimento do dano moral) da família, decorrente do abandono afetivo do idoso. Com base nas características do “Abandono afetivo”, para verificar qual é o compromisso da família em dispensar aos mais velhos os cuidados necessários, será apresentada, na sequência, breve abordagem sobre a Constituição da República Federativa do Brasil, de 1988, e o Direito do Idoso, para ressaltar o tratamento conferido a ele pela Legislação Maior; Da Constituição para a Legislação, o conjunto de institutos que derivam da Constituição Federal na proteção do idoso e o Cabimento da Responsabilidade Civil, para tentar responder às seguintes perguntas: Qual a responsabilidade civil da família que abandona o idoso? O idoso pode ser indenizado pelo dano provocado por seus descendentes?

ABSTRACT

This article seeks to highlight the possibility of liability pertinence (pertinence of moral damage), the family due to the affective abandonment of the elderly. Based on the characteristics of the " emotional abandonment " to see which is the family 's commitment to dismiss older to the necessary care; following a brief overview will be presented on " The Federal Constitution of Brazil 1988 and the Law of the Elderly" , to highlight the treatment given to the elderly by Major legislation; " The Constitution for legislation" will present the set of institutions that derive from the Constitution in the elderly protection ; and finally the " appropriateness of Liability " , to try to answer the following questions : what is the liability of the family who leaves the elderly ? The elderly can be compensated for the damage caused by his descendants?
