AÇÃO PENAL PRIVADA E VINGANÇA: UMA ANÁLISE DO PONTO DE VISTA DE ÉMILE DURKHEIM

Resumo

Este artigo procura salientar a relação entre a ação penal privada e a vingança privada. Com base na teoria de Émile Durkheim, na obra “Da divisão do trabalho social”, por meio da reprodução de casos de violência que ganharam repercussão nacional midiática por explorar a “justiça com as próprias mãos” e a análise da literatura específica, verifica-se a ocorrência da vingança como prática punitiva que permanece viva na atualidade, ora pela punição extrajudicial, ora pela sua manifestação racionalizada e moderna na ação penal privada e em outros instrumentos legais.

ABSTRACT

This article aims to point out the relation this article sought to highlight the relationship between private criminal action and private revenge. Based on Emile Durkheim's theory, in the book "The division of labor" through the reproduction of violence that won national impact media to explore the "law into their own hands" and analysis of the literature, checked the occurrence of vengeance as a punitive practice that remains alive today, prays for extrajudicial punishment, sometimes for its streamlined and modern manifestation in the private prosecution and other legal instruments.
